Terms and Conditions of Sale

1. Purpose and scope

These Terms and Conditions of Sale (hereinafter "TCS") govern exclusively the paid plans offered by MYWIE to adult natural persons acting as consumers, for private, non-professional use.

These TCS supplement the Terms of Use (TOU), available at /conditions, which govern general use of the platform, including the free version. In the event of any conflict, the TCS prevail for everything relating to paid services. /conditions

Any subscription to a paid plan constitutes full and unreserved acceptance of these TCS.

2. Seller identification

MYWIE est édité par MBMemory, au capital de 5 000 €, immatriculée au RCS de La Rochelle sous le numéro 107 568 867 (SIRET 107 568 867 00017), dont le siège social est situé 220 avenue Carnot, 17000 La Rochelle, France.

3. Description of plans

MYWIE offers three plans:

• Essential plan — free, no commitment. Governed exclusively by the TOU.
• Family plan — monthly subscription of €9.99 incl. VAT/month, no commitment, cancellable at any time. Includes extended family features, multi-member sharing and priority access to new features.
• Legacy-Plan – einmaliger Kauf mit lebenslangem Zugriff. Aktionsstartpreis: 249 € inklusive Steuern (anstelle von 490 € inklusive Steuern) für die ersten 1.000 validierten Abonnements, in chronologischer Reihenfolge der Zahlung (siehe §4). Ab diesem Schwellenwert gilt automatisch der Standardpreis von 490 € inkl. MwSt. Es umfasst alle MYWIE-Funktionalitäten definitiv für den Kontoinhaber, die benannte Vertrauensperson und die Übermittlung an Erben gemäß den in den AGB beschriebenen Bedingungen.

5. Order process

The order follows four steps: (i) plan selection on /pricing, (ii) account creation or login, (iii) acceptance of these TCS and secure payment, (iv) email confirmation.

A confirmation email summarising the order, price, billing frequency where applicable, and the right of withdrawal (see section 7) is sent without delay to the registered address.

Pour la Formule Famille, le prélèvement est mensuel, à la date anniversaire de la souscription. Pour la Formule Héritage, le paiement est unique et intégral au jour de la commande.

En cas d'échec de prélèvement (Formule Famille), l'accès aux fonctionnalités payantes est suspendu à l'issue d'un délai de sept (7) jours calendaires, sans que les données du compte ne soient supprimées.

6. Duration, renewal and cancellation

La commande se déroule en quatre étapes : (i) sélection de la formule sur /pricing, (ii) création ou connexion au compte, (iii) validation des présentes CGV et paiement sécurisé, (iv) confirmation par email.

Un email de confirmation récapitulant la commande, le prix, la fréquence de facturation le cas échéant, et la faculté de rétractation (voir article 8) est envoyé sans délai à l'adresse déclarée.

7. Right of withdrawal

Familienpaket

L'abonnement est souscrit pour une durée d'un mois, renouvelable tacitement par périodes successives d'un mois. Le client peut le résilier à tout moment depuis son espace personnel « Mon compte », rubrique Facturation. La résiliation prend effet à l'échéance de la période mensuelle en cours ; aucune période déjà réglée n'est remboursée au prorata.

Legacy-Paket

Auf unbestimmte Zeit lebenslang abonniert (Lebensdauer des MYWIE-Dienstes). Keine stillschweigende Verlängerung. Im Falle einer Abschaltung des MYWIE-Dienstes wird ein vollständiges Datenportabilitätsverfahren (verschlüsselter Export) ohne zusätzliche Kosten bereitgestellt.

8. Refunds

If withdrawal is validly exercised (section 7), MYWIE refunds all amounts paid within a maximum of fourteen (14) days of receiving the statement, using the same payment method as the order, unless otherwise agreed.

No refund is due in the event of express waiver of the right of withdrawal (see section 7), or cancellation of a monthly subscription during the current period.

Express-Verzichtserklärung: Da es sich bei MYWIE um einen digitalen Dienst mit sofortiger Ausführung handelt, wird der Kunde, der vor Ablauf der Widerrufsfrist Zugang zu kostenpflichtigen Funktionen erhalten möchte, gebeten, zum Zeitpunkt der Zahlung ein Kästchen für die Express-Verzichtserklärung anzukreuzen (Art. L.221-28 13° des Verbraucherschutzgesetzes). In diesem Fall erlischt das Widerrufsrecht ab Beginn der Leistungserbringung.

9. Legal warranties

Customers benefit by law from the legal conformity warranty (Art. L.217-3 et seq. of the French Consumer Code) applicable to digital content and services, as well as the warranty against hidden defects (Art. 1641 et seq. of the French Civil Code).

Any warranty claim must be sent to contact@mywie.fr.

10. Service availability

MYWIE uses reasonable means to ensure continuous access to the service. It cannot however be held liable for interruptions due to planned maintenance, force majeure or third-party network failure.

The service is hosted in France with a European hosting provider. No customer data is transferred outside the European Union. contact@mywie.fr.

11. Personal data

Personal data processing is described in the GDPR policy. Billing data is retained for ten (10) years in accordance with French accounting and tax obligations.

Der Dienst wird in Frankreich bei einem europäischen Host gehostet. Es werden keine Kundendaten außerhalb der Europäischen Union übertragen.

12. Mediation and disputes

Le traitement des données personnelles est décrit dans la politique RGPD. Les données de facturation sont conservées dix (10) ans conformément aux obligations comptables et fiscales françaises.

13. Applicable law

These TCS are governed by French law. Any dispute relating to their formation, interpretation or performance falls within the jurisdiction of the competent French courts, subject to more favourable provisions for the consumer. 14. Changes to these Terms

MYWIE reserves the right to update these TCS to reflect legal, regulatory or offer changes. Any material change is notified by email to affected customers at least thirty (30) days before it takes effect, and allows the customer to cancel their subscription free of charge if they do not accept the new terms.

15. Contact

MYWIE behält sich das Recht vor, diese Allgemeinen Geschäftsbedingungen zu ändern, um rechtlichen oder behördlichen Entwicklungen oder seinem Angebot Rechnung zu tragen. Jede wesentliche Änderung wird den betroffenen Kunden mindestens dreißig (30) Tage vor ihrem Inkrafttreten per E-Mail mitgeteilt und ermöglicht dem Kunden die kostenlose Kündigung seines Abonnements, wenn er die neuen Bedingungen nicht akzeptiert.
